There’s a case brewing in New York that has been brewing for several years now and now it appears that it’s about to boil over. The case involves a sadistic prison guard and accusations of torture, sexual harassment, and assault carried out by this officer on inmates at the Auburn Correctional Facility. But the prison guard isn’t just a lowly prison guard as he hold the rank of Lieutenant.
It appears that thus far Lt Troy Mitchell has cost the State of New York an astounding $877k in legal payouts pertaining to accusations of sexual harassment and other legal matters involving both prisoners and other guards at the facility. The Lt is accused along with other guards of water boarding two inmates that were shackled by pouring buckets of water over their mouths and noses. He’s also being accused of grabbing and twisting the genitals of other inmate and then punching and whacking them in the groin with a baton.
In one incident dating from September of 2016 Mitchell is alleged to have beat a prisoner named Matthew Raymond so savagely that he now needs a catheter to urinate! He allegedly then ordered a guard to spread Raymond’s legs apart after which Mitchell is said to have begun grabbing and twisting Raymond’s penis and testicles while calling him a “stupid little bitch” according to court documents. The Correctional Department’s inspector general previously investigated Raymond’s accusations and determined there was nothing to them. However, that investigation has now been reopened because a second prisoner has made the same accusations against Mitchell. That incident allegedly took place in 1986 when Mitchell was a lowly prison guard and had just started working for the department. A third prisoner has also filed similar accusations in court now as well alleging the same behavior by Mitchell which allegedly took place in 2016.
Lt Mitchell was suspended without pay in August of last year as the investigation into his behavior and that of other prison guards continues. However, Mitchell’s alleged barbaric and very sadistic behavior goes back even further than what is being alleged against him now. Penny Collins who is now a family therapist was a guard at the same facility and she was awarded a $787k dollar settlement in a claim she filed against Mitchell for sexual harassment plus $150k in back pay in 2012. That was 5 years after she filed against Mitchell and other guards at the facility. She calls Mitchell the “worst of the worst.” In court documents she accused Mitchell of repeated verbal abuse and bullying. In that same filing she alleged that Mitchell described his excrement to her and boasted how he once told his own mother that she had nice breasts! He also once told Collins that her wedding ring looked like one that his wife owned that got “lost in his ass.” Collins said at the time that Mitchell liked to frequently discuss the size of inmates’ penises!! Is this puppy with a badge a SICKO or what???? Sounds to me like he needs to be on the other side of the bars! But, hey, “innocent until proven guilty” right?
Collins describes Mitchell as “on of the sickest people I’ve ever met in my entire life.” She says that in November of 2006 she was so concerned about Mitchell’s sadistic and sick behavior and history of abuse directed at inmates and coworkers that she wrote a letter to the department’s inspector general warning them that such incidents were going unreported and that letter was sent at the very same time Mitchell was being promoted to Lieutenant! In that letter Collins wrote, “With this promotion, he (Mitchell) now has a substantial amount of authority and I fear for the people he turns his abuse on.” Investigators from the IG office interviewed Collins about the accusations and concerns expressed in her letter but she says after that interview she never heard another thing about it. Sounds to me like the IG didn’t follow-up on the investigation and didn’t take her concerns and allegations seriously! People in the IG office should now be FIRED!! Collins says if the IG would have taken her concerns seriously 12 years ago Mitchell’s behavior would be an issue now.
Ironically, Mitchell and other guards at the facility were under scrutiny even before Collins accusations! It appears the powers that be in the NY Correctional Department didn’t take any of the accusations seriously and just turned and looked the other way! I have a feeling all this is now going to cost the State of New York a bundle! The US Justice Dept investigated the facility in 2005 over allegations made by prisoners of guards using excessive force. That probe was ended two years later after the statute of limitations expired. That probe, however, was going on at the same time several prisoners were complaining about Mitchell’s behavior.
One prisoner accused Mitchell and other officers of breaking both of his hands, an ankle, his nose, and a tooth during an assault against him by Mitchell back in 2002. That prisoner got a settlement of $70k in 2008 according to court documents. In yet another incident another prisoner got a $19.8 dollar settlement in 2008 after he accused guards and Mitchell of assaulting him while he was handcuffed in a utility room at the prison in 2002.
Mitchell denied the sexual harassment and other accusations made by Collins and prisoners. The Correctional Department says it is limited in its ability to discipline guards under a contract with the union. WTF? That’s OUTRAGEOUS!! The DOC says it is now working on a new contract with the union that will give it more power to remove guards like Mitchell. Well the fact is that Mitchell has committed CRIMES so he can and SHOULD be charged with those crimes and to hell with the union contract!!! However, as prisoner advocates point out cases involving abuse by officers against prisoners SELDOM end with criminal charges. Why not? Are these guard above the law? The State of New York needs to answer for this!
In one case a prisoner who had a traumatic brain injury before going to prison and who has a seizure disorder alleged that Mitchell attacked him after he was taken to a local hospital in Auburn. That prisoner reportedly suffered a seizure and was taken to a local hospital in handcuffs and a belly chain. In that court filing it alleges that prison guards accused him of being “disruptive” even though medical records show that the prisoner was shackled the entire time and in a confused and disoriented state following the seizure which is typical of seizures. After getting medical care this prisoner was taken back to the prison and on the way back he experienced yet another seizure and vomited on himself. Back at the prison he was taken to a small room in the medical unit where he alleges that Mitchell and 5 other guards attacked him while he was still shackled. Reportedly, the waterboarding was followed by Mitchell hitting the prisoner in the face, neck, and chest. The attack allegedly continued even after another guard interceded to say that the prisoner had had a seizure. When the prisoner attempted to close his legs Mitchell allegedly punched him in the groin and repeatedly struck him in the groin with a baton! That prisoner did not get any further medical attention even after he reported blood in his urine! In January of 2017 that same prisoner found himself unable to urinate and was taken to Upstate University Hospital in Syracuse where doctors there concluded that his INJURIES WERE CONSISTENT WITH BLUNT FORCE TRAUMA TO HIS GENITALS!!
Mitchell needs to be brought to justice and answer for his CRIMINAL behavior! If what is being alleged by these prisoners is anywhere near the truth then this man is a sadistic MONSTER with a badge!! Our prisoners should NOT be treated like this and NONE of them should ever be tortured period!!
When this kind of behavior is uncovered be it by prison guards, police, or anyone else it needs to be stopped! Despite what they have done prisoners are STILL human beings and torturing them is inhumane to the limit! Just because someone carries a badge does NOT mean that that person is above the law. Mitchell is standing accused of committing crimes and he should have his day in court and the prisoners who felt the brunt of his abuse should be vindicated not for their crimes but for the crimes committed against them. This is America not the old Soviet Union or Nazi Germany! Mitchell and others like him must no longer be allowed to freely do whatever they please. Sadly, there are criminals AND there are criminals with badges and guns or batons too. It’s time to root out the bad seeds across this nation and put the word out loud and clear that this sort of behavior is NOT going to be tolerated in our correctional system!!
